The rules of the road for using Adventa AI

Acceptance

By accessing or using Adventa AI (the “Service”), you agree to these Terms of Use. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

The service

Adventa AI is a retail traffic intelligence platform from Dragonfruit AI. It is licensed, not sold. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business operations during the term of your subscription.

Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code.
  • Use the Service to surveil individuals or perform facial recognition.
  • Resell, sublicense, or provide the Service to third parties.
  • Use the Service to violate applicable laws or third-party rights.

Customer data

You retain ownership of your data. You grant us a limited licence to process it for the purpose of operating and improving the Service, subject to our Privacy Policy.

Service availability

We aim for high availability and publish SLAs in our enterprise agreements. Scheduled maintenance windows will be announced in advance.

Fees & payment

Fees are agreed in your order form. Unless otherwise stated, invoices are due net 30. Late payments may incur interest at the lesser of 1.5% per month or the maximum allowed by law.

Confidentiality

Each party agrees to protect the other’s confidential information using reasonable care and to use it only for purposes of the Service.

Warranties & disclaimers

The Service is provided “as is” except for warranties expressly stated in your order form. To the maximum extent permitted by law, we disclaim all other warranties, express or implied.

Limitation of liability

Except for indemnification obligations and breaches of confidentiality, neither party will be liable for indirect or consequential damages. Each party’s aggregate liability is capped at fees paid in the 12 months preceding the claim.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
